Information about PashaPay

This Agreement is entered into by and between PashaPay and the User.

Hereinafter, PashaPay and the User may be referred to separately as a "Party" and collectively as the "Parties."

When the User click the "Confirm" button to approve this Agreement, he/she expresses his/her will in accordance with the legislation of the Republic of Azerbaijan to enter into the Agreement.

Key Definitions

Authentication - A procedure that allows PashaPay to verify theUser's identity or the integrity of the payment instrument, including theUser's personalized security information, in accordance with the legislation ofthe Republic of Azerbaijan;
Authorization - The User's consent to PashaPay for the execution of a payment transaction;
Direct Debit - The payment instrument used for debiting the User's payment account for the execution of the payment transaction, based on the payee’s payment order in accordance with User's consent to payee, payee’s or User’s prior consent to PashaPay;
Blocking - Restriction of access to the electronic money account or full or partial suspension of the execution of payment transactions in cases determined by this Agreement, legislation or PashaPay's internal rules;
Device - Any mobile phone, tablet, or other computingdevices that enable User to access the m10 platform;
Electronic Money - A payment instrument issued by PashaPay to theUser in the amount of received funds, stored in electronic form, enabling theexecution of payment transactions and accepted for payment by third parties;
Personilized Security Information – Personalized information provided by PashaPay tothe User for authentication purposes;
Enhanced User Authentication - Authentication based on use of two or more of thefollowing elements: known only the User (e.g., password,  PIN,  set of questions, etc.), inherent to the User(e.g., facial recognition, voice recognition, fingerprint), andpossessed  only the User (e.g., a device, OTP, TOTP,electronic signature);
User - A natural person using the payment servicesprovided through the m10 platform. You are considered a User from the momentyou click the "Confirm" button to confirm this Agreement;
Credit Transfer - A payment instrument used by PashaPay for thepurpose of transferring funds, based on the User's payment order;
Privacy Policy - The privacy statement published by PashaPay at theinternet address https://m10.az/en/privacy-policy, which explains how PashaPay processes the User'sinformation;
m10 Platform (m10 Wallet) – the software or website, where all property andintellectual property rights belong to PashaPay, on which the User can access paymentservices by connecting through a device;
Agreement - The present Agreement concluded between PashaPayand the User regarding the provision of payment services that comes into forcefrom the moment the User click the "Confirm" button in the m10 Platform;
Payment Transaction - Receiving, transferring or withdrawing money at theinitiative of the User or the recipient of the money, regardless of anyobligationsbetween them;
Refusal to Perform a Payment Transaction -
refusal to complete a payment transaction, such astransferring funds, crediting to a  payment account, returning  funds to  the balance, and other operations;
Payment Account - An account opened by PashaPay for the User on them10 Platform for the execution of Payment Transactions;
Payment Order – an order  issuedby the User to PashaPay on the m10 Platform to perform a Payment transaction;
Intermediary - PashaPay or another payment service provider thatprovides intermediary services for conducting  payment transactions;
Payment Intermediary Service for the Execution of a Payment Transaction - theservice of issuing a payment order to an account opened  with another payment service provider, basedon the request of the User of payment services.

1. Subject of the Agreement

1.1. This Agreement governs the the use of the m10 Platform, opening, maintening, and closing  of payment accounts, conducting payment transactions, issuing, using, and returning  electronic money, as well as the rules for using other payment services and functionality provided through the m10 Platform.
1.2. Without prejudice to the relevant provisions of this Agreement PashaPay may provide the User with the following services through the m10 Platform, :
• Cash receipt or withdrawal transaction to a current account;
• Execution of   Payment Transactions by credit transfer, direct debit, payment card, or other similar payment instruments;
• Issuance of payment instruments and (or)  acquiring of  Payment Transactions;
• Money transfer;
• Issuing  electronic money and carrying out  Payment Transactions using  electronic money;
• İntermediary services for conducitng  Payment Transactions;
• Accoutn information services;
• Currency exchange;
• Provisions of  loans within the limits established  by law;
• Provision of other innovative services and products as agreed  with the User. Note: The terms of Services are published on the m10 Platform.
1.3. In PashaPay, either alone or in conjunction with banks and other payment service providers, issues payment cards to the User within the limits permitted by law, the User may use such cards digitally through the m10 Platform. The User can obtain information about completed Payment Transactions and the balance of electronic money on the Payment Account through the m10 Platform.

2. Payment Account

2.1. In order to provide services, PashaPay opens a Payment Account on the m10 Platform for the User. By this Agreement, the User authorizes PashaPay to open a Payment Account for him.
2.2. The User who has not undergone the identification process will be subject to a transaction limit of 300 (three hundred) manats when using the payment services specified in clause 1.2 of this Agreement.
2.3. Thus, the volume of domestic payment transactions per one payment instrument within a calendar month and the amount of funds stored on this instrument should not exceed 300 (three hundred) manats or its equivalent in foreign currency.
2.4. Payment instruments that do not require identification can only be used for domestic payment transactions and such instruments may not be used for money transfers or cash withdrawals. In cases stipulated by the legislation, execution of certain payment transactions specified in clause 1.2 of the Agreement may also be restricted for the specified payment instrument.
2.5. If the User wishes to perform payment transactions specified in clause 1.2 of this Agreement without any monetary limits or usage restrictions he or she should complete the identification procedure in accordance with the requirements of the legislation. In this case the requirements of clauses 2.2-2.4 of this Agreement shall not apply to such User.
2.6. Subject to the requirements of the relevant legislation, apply authetication or enhanced authentication of the User when opening a Payment Account and  at a later stage when the User  remotely accesses the Payment Account and/or during each Payment Transaction.
2.7. The storage of Cryptocurrency is not allowed  on the balance of the Payment Account. 2.8. Except in the cases and in the manner permitted by the relevant legislation, the Payment Account may not be used by the User for business  purposes
2.9. PashaPay may unilaterally write off the User's debt from his account balance.  
2.10. The User can top up the Payment Account using payment cards, payment terminals, or other methods. Information on payment methods for  topping up the balance  of the Payment Account is posted on the m10 Platform.

3. Electronic Money

3.1. For the purpose of issuing electronic money, PashaPay immediately issues to the User's Payment Account electronic money in the amount of funds received from the User.
3.2. The User understands and acknowledges that the issuance of electronic money depends on the acceptance of funds by the bank responsible for the acquiring on the m10 Platform. 3.3. PashaPay may unilaterally block funds stored in a Payment Account, set limits on the amount of electronic money stored in a Payment Account or transactions in a Payment Account by restricting the amount, number and type of Payment Transactions or applying other necessary measures in accordance with the requirements of this Agreement and applicable law.
3.4. PashaPay ensures the security of funds in the Payment Account  in accordance with the requirements of the legislation, by storing them in banks operating in the Republic of Azerbaijan or local branches of foreign banks, or by other means. In all cases, the responsibility of ensuring the security of funds lies with PashaPay, and for this purpose it may independently choose any legal method of ensuring security permitted by the relevant legislation of the Republic of Azerbaijan.
3.5. Electronic money is not considered a deposit and is not insured, and no interest or other income is paid on the electronic money in the Payment Account of the User on the m10 Platform.

4. Authentication

4.1. PashaPay may authenticate the User prior to opening a Payment Account or at any time after opening a Payment Account  at its own discretion. The determination of authentication requirements, actions, and methodologies is solely within the authority of PashaPay in consideration of, the requirements of the relevant legislation.
4.2. Authentication measures may be implemented taking into account the amount of money held in the Payment Account and/or the amount and number of Payment Transactions. The first sentence of this clause does not limit the right of PashaPay to apply authentication measures at any time and on any grounds
4.3. PashaPay informs the User about the authentication measures applied by publishing them on  the m10 Platform, via email, SMS notifications, or  otherwise.
4.4. During topping up the balance of the Payment Account through the m10 Platform, PashaPay, banks, and other payment service providers mayapply authentication or enhanced user authentication in compliance with the legislation, their internal regulations, and practices. When such measures are implemented by banks and other payment service providers, the relationship on authentication or enhanced authentication of the User is regulated  between the User and this organizations, and PashaPay bears no responsibility for this.
PashaPay provides the User with personalized security information to authenticate him remotely. The User must keep this information secure.

5. User Responsibilities with respect to Payment Instrument and Personalized Security Information

5.1. If the User discovers that personalized security information is known to a party, he must immediately change this information  through the m10 Platform, and if this is not possible, then notify PashaPay about it.
5.2. PashaPay is not responsible for the security of the User's device and the mobile phone number linked to the Payment Account on the m10 Platform. In the event of loss or theft of the User's device, or if the User otherwise suspects or discovers that third parties have access to the User's Payment Account, he/she must immediately inform PashaPay in any possible form (written, electronic, etc.) using the means of communication published on its official pages in the social media.
5.3. The User understands and agrees that he/she are  fully responsibile  for the use of the Payment Account by third parties, regardless of whether he/she has given the consent to access and use the Payment Account or not. PashaPay shall  be liable for damage caused to the User as a result of unauthorized or unauthorized access to the User's Payment Account in cases beyond  the PashaPay control.
5.4. PashaPay shall not be liablie for restoring access to the User's Payment Account and/or the m10 Platform unless the User obtains a duplicate SIM card or otherwise provides access to the same phone number in other ways.

6. Payment transactions

6.1. Using the functionality provided by the m10 platform, the User can issue a payment order to PashaPay for the  execution of the Payment Transaction
6.2. The User is required to provide necessary information for execution of  payment order for each Payment Transaction through the m10 Platform.
6.3. The list of necessary information provided to the User by PashaPay before performing a Payment Transaction and the period for its provision are determined by PashaPay unilaterally in compliance with the requirements of the applicable legislation.
6.4. After the Payment Transaction is completed, PashaPay notifies  the User. The list of information provided to the User and the period for providing such information are determined by PashaPay unilaterally in compliance with the requirements of the applicable legislation.
6.5. Depending on the functionality of the m10 Platform and the services provided by PashaPay, Payment Transactions may be executed by credit transfer or direct debit, as well as by other similar payment instruments allowed by law.
6.6. In case of  a credit transfer, the User is fully responsible for the correct selection of the recipient of funds and, if required, for the correct entry of his/her data. PashaPay is not responsible for the  incorrect selection of the recipient of funds by the User or incorrect entry of data. In accordance with the requirements of clause 10.1 of this Agreement, PashaPay may take appropriate measures to return  funds. When performing a direct debit, the User is responsible for the correct identification of a person authorized to issue the payment order (payment instruction) and for its proper issuance For direct debiting, PashaPay obtains the User's consent in advance. In this consent, the User also specifies the limit for the amount to be paid by direct debit.If the  amount of direct debit transaction  exceeds the limit set by the User, the User may contact PashaPay within 2 (two) months from the date the payment was debited from his/her Payment Account, the delay of the period deprives the User from this right. PashaPay shall refund the User the overpaid amounts or provide the User with information about the reasons for refusal to refund within 5 (five) working days after receiving such request.
6.7. The User can transfer electronic money to other Users or third parties who  accept electronic money as a payment instrument.  
6.8. Execution of a Payment transaction using various graphical means (such as QR or bar codes) or any other non-traditional means does not affect the validity of the Payment transaction. If the User has been notified in advance that this action is a request to perform a Payment transaction, then in such cases performing the required action (for example, scanning a QR or barcode) is considered authorized by the User.
6.9. The execution of  Payment Transactions depends on the functionality of the m10 Platform and the services provided through it. If the m10 Platform does not support a certain Payment Transaction (e.g., direct debit), the provisions of this Agreement regarding this type of transactions will not apply. Under no circumstances does PashaPay undertake to provide functionality for a particular Payment Transactions.

7. Giving Payment Orders, Moment of Acceptance, and Execution Period

7.1. The User is considered to have authorised the Payment Transactions when he clicks the complete transaction icon  on the m10 Platform in a way that is obvious to him (e.g., "pay," "complete transaction", "confirm," "transfer," etc.), while conducting Payment Transaction.
7.2. , PashaPay accepts an authorized payment order for execution if the payment order does not contain any errors and all conditions specified in this Agreement and/or on the m10 Platform are met by the User.
7.3. An authorized payment order submitted after the day of the operation is considered accepted on the next business day.
7.4. PashaPay executes the payment order within the next business day from the time of accepting the payment order.
7.5. When a Payment Transaction is carried out by direct debit, PashaPay executes the payment order on the date agreed with the User.  
7.6. The User agrees that, subject to approval on the m10 Platform, as well as in certain cases when, due to technical circumstances, the required amount is not available on his account, PashaPay has the right to ensure the execution of his payment order (overdraft). In this case, given that the payment was made using PashaPay funds, the User agrees that he is obliged to return these funds to PashaPay no later than 30 (thirty) days. In this regard, if PashaPay does not provide the User with a longer period of time through the m10 Platform, the User is obliged to return the specified funds and interest on the amount of these funds to PashaPay for the use of funds (in the manner and within the limits determined by law) within the agreed period.
7.7. The User agrees that in accordance with paragraph 7.6 of this Agreement, PashaPay may, at its own discretion, write off funds from his payment accounts known to PashaPay if he does not return them within the specified period.

8. User's refusal of a payment order and revocation of a payment order

The User may cancel a payment order at any time until the moment specified in clauses 8.2 - 8.5. As a result of refusal of an issued payment order  to perform  periodic Payment Transactions, only the transaction whose execution time has been reached or all subsequent Payment Transactions are considered unauthorized and are  not  executed, depending on the User's choice.
8.1. The User may not recall a payment order sent to payment system from the moment determined by the rules of the relevant payment system.
8.2. If the User agrees on a date with PashaPay for the execution of the payment order, the User may revoke the payment order no later than the end of the business day preceding the agreed one.
8.3. Once a Payment Transaction is initiated by a intermediary, the User does not have the right to cancel  the payment order after providing the intermediary with consent to such  initiative.
8.4. When using a direct debit tool, the User may recall the payment order no later than  the end of the business day preceding the day on which the funds are to be debited from the Payment Account.

9. Notification on Unauthorized or Improperly  Executed Payment Transactions

9.1. If the User identifies any unauthorized or incorrectly executed Payment Transactions within 6 (six) months after the execution of the Payment Transaction, the User must immediately inform PashaPay on this. Otherwise, the User is deprived of the right to  obtain rectification of an executed Payment Transaction.
9.2. Upon receipt of the notification from the User, referred to in clause 9.1, if PashaPay does not confirm that the Payment Transaction has been  authenticated, correctly registered, the amount of the Payment Transaction has been credited to the Payment Account specified by the User, and the Payment Transaction has  not been affected by technical malfunctions or other failures in operation due to  the fault of no later than 5 (five) business days (and in transactions carried out by payment instruments outside the country –  within the period determined by the rules of the payment system of which it is a participant), then  PashaPay, within the period established by law, returns  the amount of the Payment Transaction to the User together with the paid service fee (if applicable).

10. Possibility of refunding funds for unreasonable written-off from the Payment Account and  erroneously executed Payment Transactions

10.1. PashaPay is not capable to  track  or control the use of funds by User. Considering this, in case the User provides incorrect information for the execution of a payment order, PashaPay will not be responsible for the return of funds. However, if a Payment Transaction is executed based on incorrect information provided by the User, the User may apply to for a refund of the Payment Transaction by submitting  all supporting documents to  PashaPay within 2 (two) months from the date of execution of the Payment Transaction. If  PashaPay considers this request reasonable and if it is possible to return  funds, then PashaPay may refund the money to the User by following the rule outlined in clause 10.2 of the Agreement.
10.2. Considering clause 10.1 of this Agreement, the User agrees if funds are unreasonably written off or erroneously credited to his/her Payment Account by another User, PashaPay may take necessary measures and conduct investigations to return  those funds to the other User. In such cases, the User accepts to cooperate with PashaPay to return erroneously  transferred funds. However, based on any other ground PashaPay reserves the right to unilaterally (without further authorisation) debit the  funds erroneously or unreasonably transferred  to the User’s Payment Account from his/her any other payment account. By signing this Agreement, the User is considered to have given prior consent to such withdrawal of funds.

11. Service Fee and Currency Exchange Rate

11.1. PashaPay may apply and require a service fee from the User for the provision of the following services:
11.1.1. Opening a Payment Account;
11.1.2. Issue of  electronic money;
11.1.3. Execution of  Payment Transactions;
11.1.4. Revocation of a  payment order;
11.1.5. Provision of information (statements) on a Payment Account in hard copy  (signed and approved by a seal);
11.1.6. Provision of  information other than information provided for in this Agreement;
11.1.7. Transmitting of data by  means not provided for in this Agreement;
11.1.8. Provision of information on Payment Transactions executed during a calendar month more than once or with a greater frequency in accordance with the information provided after the execution of the payment order.
11.2. When charging a service fee or applying a currency exchange rate based on this Agreement, information about such fee and exchange rate  shall be provided to the User through the m10 Platform prior to the execution of the payment order. By confirming the  order, the User agrees to service fee and exchange rate.
11.3. PashaPay may unilaterally deduct the service fee from the funds available in the Payment Account of the User.
11.4. The User understands and accepts that other payment services providers with whom PashaPay cooperates in providing services through the m10 Platform, may, in turn, also charge a service fee. PashaPay is  not responsible for the type and amount of such commissions.

12. Licensing

12.1. All rights, including intellectual property rights to the m10 Platform belong to PashaPay. without limitation, source text and object codes of the m10 Platform are protected by copyrights owned by PashaPay's.
12.2. According to the Agreement, PashaPay grants the User a non-exclusive license to use the m10 Platform, i.e. gives him the right to use the platform. PashaPay retains all ownership rights to the m10 Platform.
12.3. The User may not copy, distribute, or modify  the m10 Platform. The User may not transfer, sublicense, sell, gift or otherwise alienate the license to the m10 Platform to third parties.
12.4. The User may not extract the license information from the source code of the m10 Platform.
12.5. The User may not, under any circumstances,  reverse engineer the m10 Platform.

13. Data processing

13.1. PashaPay processes, secures, and discloses the User's personal data to the third parties in accordance with the applicable laws and the existing Privacy Policy.
13.2. Personal data is processed for the purposes of executing this Agreement, marketing,  sales growth, assessing  and improving the quality of services provided, developing new products and etc. In all cases, the purposes of processing the personal data are specified in the Privacy Policy.
13.3. The services provided on the m10 Platform are not intended for children  under the age of 14. PashaPay does not collect or process personal data of children  under the age of 14 (except for users registered in cases and procedures established by law).

14. Anti-Money Laundering (AML) and Combating the Financing of Terrorism (CFT), Tax Evasion

14.1. The Parties declare that they are committed to combating the legalization of criminally obtained funds, financing of terrorism, and tax evasion.
14.2. The User shall be  fully responsibile for ensuring that the funds used in all Payment Transactions conducted through the m10 Platform have a legitimate origin and undertakes to immediately notify PashaPay and law enforcement agencies in the event of receipt of funds to the User’s Payment Account, the source of  funds, which there are reasonable doubts, including in cases  where the  Payment Transaction is itself is aimed at an attempt or the legalization (laundering) of funds obtained as a result of committing a crime, financing terrorism or other criminal acts  and the User is or should be aware of this, or if the User has reasonable doubts about the purpose of the Payment Transaction being carried out.
14.3. The User must under no circumstances participate in the legalisation or attempted legalization laundering) of proceeds from crime and the  financing of terrorism through the m10 Platform and is obliged to immediatley notify PashaPay and law enforcement agencies of any such facts that become known to him.
14.4. The User confirms that he/she has not evaded and  will not evade the payment of taxes and other mandatory payments in the Republic of Azerbaijan or other countries in connection with the use of the m10 platform or through the m10 platform.
14.5. The User is solely responsibile for the payment of all taxes, tax evasion and other mandatory charges in connection with the transactions he/she conducts on the m10 Platform. PashaPay is only a payment service provider offering payment solutions, and is not responsible for the User’s payment or non-payment of taxes and other mandatory payments and fees, including the submission of required declarations and reports to government agencies in accordance with the law.
14.6. PashaPay may at any time request additional documents from the User in connection with the Payment Transactions carried out by him.

15. Blocking, Withdrawal of Funds from the payment account, and Imposition of Certain Restrictions

15.1. PashaPay may block the User's Payment Account and/or Payment Transactions, including but not limited to the following cases:
a. If the User violates the terms of this Agreement, including the procedure for using the m10 Platform and the rules for using the Payment Account;
b. If the User does not provide PashaPay with the requested information and documents on the transactions carried out from the time of such request until the next day;
c. If its detected that the User is using the m10 Platform for entrepreneurial activities;
d. In order to ensure the security of the m10 Platform, the User's Payment Account, electronic money, and other payment instruments;
e. To prevent the use of the m10 Platform, Payment Account, electronic money and other payment instruments for fraudulent purposes or by unauthorized third parties;
f. When carrying out a payment transaction,  which as a result of a technical error, exceeds the amount available in the Payment Account;
g. In case of transfer of money to/from the User's Payment Account as a result of unauthorized access to the User's Payment Account by third parties;
h. In case of suspision of illegal use by the User of the Payment Account and the m10 platfrom for legalization of property obtained by criminal means, financing of terrorism, including for carrying out non-standard or unusually complex payment transactions that differ from the payment transactions carried out by the User in the usual manner;
i. In order to prevent evasion of taxes and other mandatory payments and fees under applicable law;
j. If the User, on the basis of this Agreement and applicable legislation, does not comply with the authentication requirements on the m10 Platform;
k. In order to prevent the risk of the User being unable to fulfil his obligations under the credit lines allocated for payment instruments;
l. If the User has a debt to PashaPay and the balance in his/her Payment Account, or Bir bonuses as stipulated in Clause 21 of the Agreement, is insufficient to settle that debt;
m. In other cases as prescribed by internal regulations and instructions of PashaPay;
n. At the User's request;
o. In cases specified by the legislation and court decision or by a request from the relevant state authorities.
15.2. The Parties understand and accept that in all cases where necessary, PashaPay has the right to refuse to carry out a payment transactionç to restrict the User's access to the Payment Account in accordance with current legislation and in the manner established by the Agreement, the internal rules of PashaPay, provided that such rules have been previously communicated tothe User;
15.3.      Without limitation, PashaPay may deduct electronic money from the User's Payment Account in the following cases:
a. For the purpose of executing  this Agreement;
b. If the User uses more funds than the balance of the Payment Account;
c. If  the User has a debt to PashaPay;
d. Incases specified in clause 10.2 of this Agreement.
1.3. In any case, the duration of the blocking is determined in accordance with applicable legal requirements and internal regulations of PashaPay, provided that these internal regulations are previously communicated to the User.  In case of blocking of the User's Payment Account and payment transactions, refusal to carry out payment transactions or Payment Account funds are deleted, disputes are carried out in accordance with the internal rules of PashaPay and the legislation of the Republic of Azerbaijan. In case of blocking of the User's Payment Account and Payment Transactions, refusal to carry out Payment Transactions or write-off funds from the Payment Account, disputes are settled based on the internal rules of PashaPay in accordance with the legislation of the Republic of Azerbaijan.

16. Liability

16.1. The Parties shall be liable for breach of this Agreement in accordance with the legislation of the Republic of Azerbaijan.
16.2. Each Party shall be  liable for  damages caused to the other Party according to the legislation of the Republic of Azerbaijan. PashaPay shall be liable only for actual damages caused to the User under this Agreement.
16.3. The User shall be responsible for the protection of personilized security data n and other sensitive payment data.

17. Term and Termination of the Agreement

17.1. This Agreement shall be deemed concluded  from the moment the User clicks the "Confirm" button on the m10 Platform, confirming his/her consent to the Agreement. The Agreement shall remain in effectuntil terminated by the Parties.
17.2. The Agreement may be terminated in the following cases:
a. At the User's initiative - by notifying PashaPay via the m10 Platfrom at least 30 (thirty) days in advance, subject to to the fulfillment of all obligations to PashaPay are fulfilled;
b. At PashaPay's initiative - by sending the User  a notice at least 30 (thirty) days in advance, unless otherwise provided by law;
c. By immediate notification to the User by PashaPay in the following cases, unless otherwise determined by law:
i. If the User does not provide PashaPay  with the requested the information and documents on the transactions within 10 (ten) days;
ii. If the cases specified in Article 15 of this Agreement are repeated by the User over a long period of time and several times;
iii. If the User does not use the m10 wallet for a period exceeding 12 (twelve) months;
iv. In other cases stipulated by the legislation of the Republic of Azerbaijan.
17.3. Before the termination of the Agreement, the User is obliged to pay the commission for the payment services used. If payment for the service was made in advance, it is subject to return no later than the next working day after the termination of the Agreement, minus the amount payable for the payment services provided before the termination of the Agreement.
17.4. Upon termination of this Agreement, PashaPay shall return the remaining electronic money to the User in accordance with the legislation of the Republic of Azerbaijan.

18. Correspondence and negotiations

18.1. Correspondence and negotiations between the Parties can be conducted through the m10 Platform, phone calls, and email.
18.2. PashaPay contact details are provided in the "Information about PashaPay" section above. In case of changes in the contact details, the User will be informed of this through the m10 Platform.
18.3. The User's contact details are the information provided by the User to PashaPay via the m10 Platform. If these details change, the User must immediately notifyPashaPay of this.

19. Amendments and Additions to the Agreement

19.1. PashaPay has the right to make amendments and addition a to this Agreement by providing notice to the User through the m10 Platform at least 30 (thirty) days in advance. If the User does not object to the amendments and additions during this period, he will be considered to have accepted these amendments and additions.
19.2.Amendments that improve the User's position can be applied by PashaPay without waiting for the period specified in Article 19.1.

20. Applicable Law and  Dispute Resolution

20.1. This Agreement is governed by and interpreted in accordance with the legislation of the Republic of Azerbaijan.
20.2. PashaPay shall process complaints from the User within 7 (seven) business days from the date the complaint is received and inform the User of the outcome. If it is not possible to process the complaint within this period, PashaPay shall inform the User no later than this period of the period for reviewing the complaint with a justification for the extension of the review period. Filing a complaint with PashaPay does not limit the User's right to file a complaint in court.
20.3. All disputes arising between the Parties under this Agreement shall be  resolved through negotiations. If the Parties fail to reach a mutual agreement through negotiations, the dispute shall be  resolved in the authorized courts of the Republic of Azerbaijan.

21. Additional functionalities on the m10 Platform

21.1. PashaPay may update and perform maintenance works on the m10 Platform.
21.2. The organization of any loyalty programs (bonuses, etc.) or campaigns to encourage users to use the m10 wallet is the exclusive authority of PashaPay, and PashaPay may implement or suspend at any time without the consent of the User.
21.3. PashaPay may offer Users new products or new solutions on the m10 Platform as part of  cooperation  projects with third parties providing vatious services. Within the framework of PashaPay's cooperation with Competo LLC, the m10 Platform may be integrated with the latter's Birmarket Platform, and as a result of the integration, following functionalities may be offered to the User:
21.3.1. The ability of Users to track Bir bonuses on the m10 Platform, as o well as the ability to directly switch to the Birmarket Platform via the m10 Platform;
21.3.2. The ability of Users to use  bonuses collected on the Birmarket Platform for certain payments via the m10 Platform;
21.3.3.With regard to refund transactions:
21.3.3.1. Esnuring the return  of Bir bonuses to the User in case of refund operations for a payment transaction made with Bir bonuses through the m10 Platform.
21.3.3.2. Withholding bonuses accrued to him  in the event of any refund transactions for a e payment transaction made by the User through the m10 Platform.
21.4. In order to expand the range of services, PashaPay may in the future provide the opportunity to provide and/or use the services provided by third parties to Users  on the m10 Platform  within the framework of cooperation with these  third parties.

22. Other Provisions

22.1. The User may not transfer his/her rights and obligations under the Agreement to third parties without the consent of PashaPay. PashaPay may transfer its rights and obligations under this Agreement to third parties.
22.2. If provided by PashaPay, the opening of a payment account and/or the use of the m10 Platform for minors is allowed after obtaining consent from their legal representatives in accordance with the procedure established by law.
22.3. This Agreement iss a framework agreement  for the provision of payment services. Therefore, certain parts of this Agreement apply only in the case of the provision of relevant payment service.
22.4. The invalidity of any part of this Agreement does not affect the validity of other parts.
